THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.11386 of 2025 ORDER:

This criminal petition is filed by the petitioner under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of anticipatory bail in the event of her arrest in connection with Cr.No.189 of 2025 of Prohibition and Excise Station, Huzurnagar.

Heard Sri D.S.N.V. Prasad Babu, learned counsel appearing for Ms S.Vijay Mary, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 3.

The contention of learned counsel for the petitioner is that her husband is A.6 in Cr.No.189 of 2025 and a criminal case is also filed against him in the State of Andhra Pradesh, wherein he confessed her name and shifted the liability on this petitioner. As such, petitioner is apprehending arrest in the hands of police. The petitioner herein has also filed similar application in the High Court of Andhra Pradesh vide Crl.P.Nos.8381 and 8444 of 2025 and the anticipatory bail was

granted in those petitions. As such, requested this Court to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor would submit that as no FIR is registered against the petitioner herein there is no apprehension of her arrest. As such, this petition is not maintainable and prayed to dismiss the same. 5.

Considering the submissions made by the respective counsel and the material placed on record, the apprehension of petitioner herein is that in the confession statement of A.6 in Cr.No.189 of 2025, he stated that his wife i.e., petitioner herein handles the company's marketing affairs, accounts and bank transactions, and she is aware of the illegal business and she used to call the operators at Krishna Pharma and other Ethanol suppliers to supervise the supply and packing etc., which shows that there is apprehension to this petitioner to implicate her in this case. Further, the offences alleged are under Sections 34(a) r/w.37(A)(1)(ii) of Telangana Excise Act, 1968 and Section 31(1)(b) & 36(1)(b) & (e) of Telangana Excise (Grant of licence of selling by shop and Conditions of License) Rules, 2012. The petitioner herein has filed complaint under Section 498-A of IPC against A.6 and keeping grudge, A.6 has implicated the petitioner by confessing her name in his confession statement.

Considering the facts and circumstances, this court deems it fit to grant anticipatory bail to the petitioner subject to the following conditions :

In the event of arrest of petitioner, she shall surrender before the Station House Officer, Prohibition & Excise Station, Huzurnagar, and on such surrender, the said Station House Officer shall release the petitioner on bail on her executing a personal bond for Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for the like sum each. ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, from the date of surrender for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
