THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 17960 of 2016 ORDER:

Heard learned counsel for the petitioners and learned counsel for the respondents.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed with the following prayer:

'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ or order or direction more particularly one in the nature of writ of Mandamus declaring the action of the official respondents in issuing Notice under Section 450 of HMC Act, 1955, vide No.387/ACP/TPS/CZ/GHMC/2016 to the petitioner and land owners and directing to stop the construction over the premises bearing Nos.1-3-387/3 and 1-1-387/2, situated at New Bakaram, Gandhi Nagar, Hyderabad as illegal, arbitrary and in violation of Articles 14 and 21 of the Constitution of India besides in violation of HMC Act consequently set aside Notice under Section 450 of HMC Act, 1955, vide No.387/ACP/TPS/CZ/GHMC/2016 and to pass such other order or orders as this Hon'ble Court may deems fit, just and proper in the circumstances of the case'.

Though various grounds are raised, learned counsel for the petitioner mainly submits that his representation dated 10.05.2016 received on 12.05.2016 may be directed to be considered in accordance with law.

Learned Government Pleader and Sri P.Kesava Rao, learned Standing Counsel for GHMC, submits that if such representation is made, the same shall be dealt with in accordance with law. Without going into merits of the case and having regard to the circumstances stated above, the Writ Petition is disposed of directing the

second respondent to consider the representation dated 10.05.2016 made by the petitioner, after hearing all the concerned, as early as possible, preferably within a period of ten days from the date of receipt of a copy of this order.
