THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.5469 of 2017 ORDER:
This Writ Petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ or Direction, declaring the action of the respondents in not sanctioning the pensions to the petitioners though they are eligible as per the norms and despite recommended and uploaded their names by the 5th respondent under NTR Barosa Scheme, as illegal, arbitrary and discriminatory and consequently direct the respondent authorities to sanction the pension amount in accordance with the uploaded list."
When the matter is taken up, it is submitted by the learned counsel for the petitioners so also the learned Standing Counsel appearing for respondent No.6 that the issue in the present Writ Petition is squarely covered by the order of this Court in Writ Petition No.21199 of 2015 dated 10.07.2015. A copy of the same is also placed on record along with the Writ Petition as a material paper. Paragraph 2 of the said order reads as under: "Since a recommendation is made by the Mandal Parishad Development Officer, after conducting an enquiry, into the eligibility of the persons and the said recommendation is stated to be pending before Project Director, DRDA, Srikakulam, the Writ Petition is disposed of without expressing any opinion on merits, directing the Project Director, DRDA, Srikakulam, Srikakulam District, to consider the said report and if the petitioners are found to
AVSS, J W.P.No.5469 of 2017 be eligible for suitable pension, to take further course of action for sanction and release of the pension, payable to them. The entire exercise shall be completed within a period of six (6) weeks from the date of receipt of a copy of this order. There shall be no order as to costs." Following the above said order and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof.
Office to enclose a copy of the order, dated 10.07.2015 in Writ Petition No.21199 of 2015, to this order. Consequently, Miscellaneous Petitions, if any pending in this Writ Petition, shall stand closed. No order as to costs. _________________ A.V.SESHA SAI, J 20th FEBRUARY, 2017.
