HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.7444 of 2019 O R D E R :

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioners/A.1 to A.4 seeking to quash the proceedings in Crime No.174 of 2019 of Kamepally Police Station, Khammam District, registered for the offences punishable under Sections 270 and 273 of I.P.C. and Section 20 (2) of the Cigarettes and other Tobacco Products Act, 2003 (for short, 'the Act'). Heard the learned counsel for the petitioners/A.1 to A.4, learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel appearing for the petitioners/A.1 to A.4 would submit that in similar circumstances this Court vide common order dated 27.08.2018 in Crl.P.No.3731 of 2018 and batch quashed the proceedings against the petitioners therein for the offences punishable under Sections 270 and 273 of I.P.C while permitting to proceed with for the offence punishable under Section 20 (2) of the Act. Learned Additional Public Prosecutor does not dispute the same. Following the said order and for the reasons stated therein, this Criminal Petition is also allowed in-part quashing the proceedings in Crime No.174 of 2019 of

Kamepally Police Station, Khammam District, against the petitioners/A.1 to A.4 for the offences punishable under Sections 270 and 273 of I.P.C only, however, the further proceedings shall go on in respect of the offence punishable under Section 20 (2) of the Act.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
