C.S. Benjman, v. The Chief General Manager,
HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT PETITION No. 11274 OF 2007 ORDER:
When the matter was called on 17.09.2016, there was no representation on either side and, hence, the matter was directed to be listed next week, under the caption 'for dismissal'. On 23.09.2016, when the matter was listed under the caption 'for dismissal', none appeared for the petitioner and, hence, the matter was directed to be listed to this date, under the same caption. Even today, when the matter appeared in the cause list, again, there is no representation on behalf of the petitioner. Hence, I find that the petitioner, who obtained the interim order in his favour, is no longer interested to prosecute this Writ Petition, the Writ Petition is liable to be dismissed.
Accordingly, the Writ Petition is dismissed for non-prosecution. In consequence, miscellaneous petitions, if any, pending in this Writ Petition, shall stand dismissed as infructuous. No order as to costs. _____________________________ G. SHYAM PRASAD, J Date: 30.09.2016.
