THE HON'BLE SRI JUSTICE J, SREENTVAS RAO CONTEMPT CASE No.1149 of2Ot6 ORDER:

The contempt case is frled seeking to punish the respondents under Sections 10 to 1 2 of the Contempt of Courts Act, 197 | , for deliberate and willful disobedience in implementing the interim order passed by this Court in W.P.M.P.No.15534 of 20 16 in W.P.No.12394 of 2016, dated 13.04.2016.

No representation on behalf of the petitioner in the morning ald afternoon sessions. Heard learned Assistant Government Pleader for Revenue appearing on behalf of respondents.

This Court while admitting the writ petition granted interim order on 13.O4.2016 in W.P.M.P.No.15534 of 2016 in W.P.No.12394 of 2016 directing the respondents not to interfere with the possession and enjoyment of the petitioner over the subject land without follorving due process of law.

Respondent No.2 irled counter affidavit, u'herein, it has been speciltca111, stated that subsequent to the interim order, on 22.09.2017 a notice was issued under Section 7 of the A.P.Land Encroachment Act, 1905 (for short "thc Act") directing the petitioner to submit explanation. Thereafter, he passed order under Section 6 of the Act vide File No.t)/10124 l2Ol5 dated 05. 10.20 17 and also conducted patrchanama on 09.lO.2Ol7. A copy of the proceeding dated 05.10.20 17 has been enclosed along with the counter affidavit. 5.

In view of the compliance of the order datcd 13.O4.2016 , no further adjudication is required.

Accordingly, the Contempt Case is closccl . Hon'ever, the petitioner is granted liberty to avail the rctncdics as are available under law, if so advised.
