THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.22333 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration appearing for respondent No.1 and Sri C. Madhu, learned Standing Counsel for GHMC appearing for respondent Nos.2 to 5.

When the matter is taken up, it is submitted by the learned counsel for the petitioner that, in respect of the adjacent land, this Court disposed of W.P.No.38156 of 2017 and batch by way of common order, dated 13.11.2017, and a copy of the said order is filed along with the writ petition as material paper. In view of the same, there shall be similar order in this case also. The operative portion of the said order at unnumbered paragraphs 2 to 4 reads as under:

" At the hearing, learned counsel for the petitioners would submit that if the respondents 2 to 5 follow the procedure established by law before taking any coercive action in respect of the properties of the petitioners, the grievance of the petitioners stands redressed.

Learned standing counsel representing the respondents 2 to 5 would submit that the respondents 2 to 5 would follow the procedure established by law and if necessary initiate acquisition proceedings before any work of Nala is undertaken in the lands of the petitioners herein.

Recording the afore-said submissions, all the Writ Petitions are disposed of directing the respondents 2 to 5 not to interfere with the subject lands of the petitioners herein in any manner except in strict accordance with the procedure established by law."

Following the said order and for the reasons stated therein, this Writ Petition is also disposed of in terms thereof. No order as to costs.
