THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7261 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A4 seeking bail in the event of his arrest in connection with Crime No.97 of 2022 on the file of Nampally Police Station, Hyderabad District, registered for the offences punishable under Section 20(b)(ii)(B) of NDPS Act.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

It is alleged against the petitioner who is accused No.4 that he is consumer and used to purchase ganja. When Accused No.2 tried to pass-on the 2 Kgs. of ganja, police arrested Accused No.2 and sent him to judicial custody.

Learned Counsel for the petitioner submits that there are no other cases pending against this petitioner; and that this petitioner is falsely implicated.

On instructions, learned Assistant Public Prosecutor submits that there are no other cases pending against this petitioner.

In the said circumstances, this Court deems it appropriate to grant relief of Anticipatory Bail to the petitioner in the event of his arrest, subject to the following conditions:

1) The petitioner/A4 is directed to surrender before the Station House Officer, Nampally, Hyderabad, within a period of ten days from the date of this order. On such surrender, the said Station House Officer, shall release the petitioner/A4 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A4 shall appear before the concerned Station House Officer every day for a period of 30 days at 9.00 A.M., for the purpose of investigation.

3) The petitioner/A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
