THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR AND THE HON'BLE SMT JUSTICE T. RAJANI CRIMINAL APPEAL No.558 OF 2012 JUDGMENT : (per Hon'ble Sri Justice C.Praveen Kumar) This appeal is filed challenging the judgment dated 04.01.2011, passed by the II Additional Sessions Judge, Karimnagar at Jagtial in S.C.No.155 of 2010.

Today, when the matter came up for hearing, it is brought to the notice of this Court that the appellant herein died and the sole legal heir who is now sought to be brought on record is A.4 who is unwilling to come on record. Hence she cannot be made as a legal heir of the appellant.

In view of the above said facts and circumstances of the case, learned counsel for the appellant submits that nothing survives in the Appeal and the same gets abated.

Recording the same, the Criminal Appeal is dismissed as abated. Consequently, miscellaneous petitions, if any, pending in the appeal shall stand closed.
