In view of the order passed in CMA No.56 of 2011, objections raised by the insurance company in this appeal are not tenable. Objection raised in this appeal is the same that was questioned in CMA No.56 of 2011, which is negatived today therefore nothing survives in the appeal.

Hence, this C.M.A. is dismissed.

No costs.

Miscellaneous Petitions, if any pending, in this Appeal, shall stand closed.
