THE HON'BLE SMT. JUSTICE TIRUMALA DEVI EADA CRIMINAL PETITION No.10303 ot 2025 ORDER:

This criminal petition is filed seeking to quash the proceedings in CC No.697 of 2024 against the petitionersaccused Nos.1 and 2 on the file of Judicial Magistrate of First Class at Choutuppal, for the offence under Section 324(3) of the Bharathiya Nyaya Sanhitha (for short 'BNS').

Heard Mr. Pasham Abhinay Reddy, learned counsel for the petitioners and Mr.Jithender Rao Veeramalla, learned \ t Additional Public Prosecutor for the respondent No.'l-State. 3.

Learned counsel for the petitioners restricted his arguments to the extent of dispensing with the presence of the petitioners before the trial court.

Learned Additional Public Prosecutor submitted to pass appropriate orders in the petition.

Perused'the record. The offence alleged against the petitioners is under Section 32aQ) of BNS. The case is pending for trial before the trial court. Considering the submissions of the learned counsel and in the facts and circumstances of the case, r/ I

this Court deems it appropriate to dispense with the presence of \ the petitioners before the trial court

Accordingly this Criminal petition is disposed of dispensing with the presence of the petitioners before the triar court, provided they are represented by a counsel before the trial court on every date of hearing and shall appear before the trial court whenever their presence is required during the course of trial Miscellaneous Petitions pending, if any, shall stand closed.
