This Criminal Petition is filed by the petitioner/accused in Crime No.133 of 2009 of Anakalpalli Town Police Station, Anakapalli, seeking to quash the proceedings in the aforesaid Crime. The petitioner also sought to dispense with his presence and recall the Non-Bailable Warrants (NBWs) issued against him. The learned Public Prosecutor takes notice for the respondent. Heard the learned Counsel for the petitioner and perused the record.

The learned Counsel for the petitioner contends that a false complaint was foisted against the petitioner and that the record does not reveal any incriminating material against him. It appears that the case has already been numbered. In the above circumstances, the petitioner can file a discharge petition before the Court below and seek necessary remedy. The plea of the petitioner to dispense with his presence while ordering recall of NBWs issued against him cannot be accepted as no special grounds are placed before this Court.

TR, J Crl.P.No.8429 of 2017 Dt: 03.10.2017 Subject to the above observation, the Criminal Petition is dismissed.
