HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION NO. 22201 OF 2017 ORDER:
Petitioner complains inaction against respondent Nos. 2 to 4 in conducting survey initiated through notice dated 4.3.2017 as illegal and arbitrary.

After going through the material available on record, particularly notice, this Court is of the view that the 4th respondent having issued the notice has not proceeded further with the survey. The petitioner has to bring the grievance to the notice of respondent Nos. 2 to 4, but not straight away invoke this Court under Article 226 and convert the writ jurisdiction as that of an executing agency for the notice issued by the authorities. 3.
This Court is not inclined to exercise its jurisdiction in the matter. The Writ Petition fails. However, liberty is granted to represent respondent Nos. 2 to 4 and this Court has no reason to believe that respondents 2 to 4 will look into the matter and proceed in accordance with law.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
