HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.26047 OF 2016 ORDER:

Heard.

2. The case of the petitioner is that he is the absolute owner and possessor of the private land to an extent of Ac.5-00 cents in Survey No.1336 P1 of Dogigillu Village, Mudigubba Mandal, Anantapuram District, which was acquired through his ancestors. The revenue authorities had also issued pattadar passbook and title deed in his favour. While so, on 28.07.2016 at 11:00 AM, the 3rd respondent at the intervention of local political leaders came to the subject property and are laying pipe line in the land of the petitioner. It is the case of the petitioner that he has not been issued any prior notices or Land Acquisition proceedings i.e., Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Questioning the said action of the respondents, the present writ petition is filed.

3. Having regard to the facts and circumstances of the case, I deem it appropriate to dispose of the writ petition directing the respondents not to lay down pipe lines in the petitioner's private property i.e., Ac.5-00 cents in Sy.No.1336 P1 of Dorigillu Village, Mudigubba Mandal, Anantapuram District, without invoking the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. With the above direction, the Writ Petition is disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ---------------------------------------------------
