THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22814 of 2017 ORDER:

The present writ petition is filed seeking to declare the action of respondents in seizing the tractor and trailor bearing No.AP22AG 1630 & AP22C 5684, without following any procedure under statutes contemplated under Section 9Q Sub-Section 7 of Minor Mineral Concession Rules belonging to the petitioner, as illegal and arbitrary. The petitioner is questioning the seizure of the vehicle and not releasing the same by following the procedure contemplated under G.O.Ms.Nos.15.

It is to be noted that this Court in identical circumstances in W.P.No.17773 of 2017, passed the following order: "Having regard to the above, once there is no impugnment of seizure but for post seizure not applying G.O.Ms.No.15, the writ petition is disposed of directing the respondents to dispose of the seized vehicle for release either by imposing penalty of confiscation strictly in accordance with law prescribed under G.O.Ms.No.15, within a week from the date of receipt of a copy of the order". In view of the above, the writ petition is disposed of directing the respondents to deal with the seized vehicle in accordance with the procedure prescribed under G.O.Ms.No.15, within a period of one week from the date of receipt of a copy of the order. No costs.

CPK, J W.P.No.22814 of 2017 As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
