Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in issuing Survey notice dated 20.06.2015 to survey the lands in Sy. No.128/1 of Kadivella Village, Yemmiganur Mandal, Kurnool District to change the extent and boundaries of the petitioner's land in Sy No.128/2 of Kadivella Village, Yemmiganur Mandal, Kurnool District by shifting Sub-Division Survey Numbers 128/1 and 128/2 of Kadivella Village, Yemmiganur Mandal, as being illegal, arbitrary and contrary to the provisions of Section 5 and 6 of the A.P.

Survey and Boundaries Act, 1923 and consequently direct the Respondents to desist from surveying and shifting sub-division survey No.128/1 and 128/2 of Kadivella Village and changing the extent and boundaries of the petitioners land situated in Sy.No. 128 / 2 of Kadivella Village, Yemmiganur Mandal, Kurnool District. The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri M. Ganga Rao, Advocate for the Petitioners and the learned Asst. Govt. Pleader for Revenue (AP) for Respondent Nos.

Learned Asst. Govt. Pleader for Revenue (AP) requested for time for filing counter-affidavit.
