THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO. 23879 OF 2013 ORDER:
Heard the learned counsel for the petitioners and the learned GP appearing for the respondent Nos. 1 to 3. 2.
The prayer sought in the Writ Petition is as under: "... to issue a writ of Mandamus or any other appropriate Writ, order or direction declaring the impugned action of the 3rd respondent at the instance of the respondents 4 to 6 in illegally summoning 1st petitioner to police station without any case against him and pressurising him to enter into development agreement in favour of respondent 4 without following due process of law as illegal, arbitrary and violative of principles of natural justice etc., and consequently direct the 3rd respondent not to summon the petitioners to police station without assigning any valid reason and not to interfere in the civil disputes between the petitioners and the respondents 4 to 6."
3.
Respondent No.3 filed a counter affidavit denying the averments made in the affidavit filed in support of the Writ Petition and contended inter-alia that no complaint of whatsoever is received or registered against the petitioners on the file of the III Town Police Station, Khammam. Respondent Nos. 1 to 3 have neither summoned the petitioners nor interfered with the subject property. However, the petitioners
bore grudge against the unofficial respondents and in the process made baseless and vexatious allegations against the respondent Police in order to prevent them from taking any action in the event of lodging any complaint against the petitioners.
4.
Though a counter affidavit is filed disputing the contention of the petitioners, no reply is filed. 5.
However, recording the said statement that the respondent Nos. 1 to 3 are not interfering in the disputes between the petitioners and respondent Nos. 4 to 6, the Writ Petition is closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
