THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.11058 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings against the petitioner/accused No.2 in C.C.No.42 of 2014 on the file of Judicial First Class Magistrate, Kanigiri. At the time of arguments, learned counsel for the petitioner has sought permission of this Court to permit the petitioner to withdraw the criminal petition with a liberty to avail the remedies available to him under law including filing of petition under Section 70(2) Cr.P.C. to recall the non-bailable warrant (NBW) issued against him.

Permission is granted.

Hence, the Criminal Petition is dismissed as withdrawn with a liberty to the petitioner/A2 to avail all the remedies available to him under law including filing of petition under Section 70(2) Cr.P.C. to recall the NBW issued against him. The trial Court is hereby directed to dispose of the petition to be filed by the petitioner under Section 70(2) Cr.P.C. on the same day in accordance with law.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
