HON'BLE SRI JUSTICE S.V.BHATT W.P.No.2366 OF 2016 ORDER:

The petitioner challenges the order No.A9/ 5341/ 2015 dated 21.09.2015 of District Panchayath Officer, West Godavari District/ 2nd respondent, as illegal and violative of principles of natural justice. The 4th respondent in the writ petition, on 21.09.2015 complained against the construction undertaken by petitioner in terms of Building Permission granted in BLR No.34/ 2014-15 dated 11.03.2015. On the very same day, the permission granted by 3rd respondent was cancelled. The order dated 21.09.2015 discloses that without affording opportunity to petitioner, the Building Permission granted to petitioner was cancelled by 2nd respondent. On the short ground that the permission was cancelled without hearing the petitioner, the order dated 21.09.2015 is set aside, matter remitted to 2nd respondent for disposal in accordance with law, within six weeks from the date of receipt of a copy of this order. The writ petition is ordered as indicated above. No order as to costs.
