HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.25536 OF 2019 ORDER (ORAL) :

This writ petition is filed by the petitioner seeking to declare the action of the 4th respondent - Inspector of Police, Ashwapuram, Badhradri Kothagudem District, in threatening the petitioner to settle the matrimonial matter with respondent No.5 or else false criminal cases will be filed against him and his family members, as being illegal and arbitrary.

2. Heard Sri Rapolu Bhaskar, learned counsel for the petitioner, and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4, and perused the material on record.

3. The learned Assistant Government Pleader for Home based on the written instructions dated 27.11.2019, a copy of which is placed on record, submits that on the complaint lodged by respondent No.5, respondent No.4 registered a case in Crime No.67 of 2019 against the petitioner for the offences punishable under Sections 498-A and 506 of Indian Penal Code, 1860, and Sections 3 and 4 of Dowry Prohibition Act, 1961, and investigated into. He submits that after the investigation, notice under Section 41(A) of the Code of Criminal Procedure, 1973, was served on the accused persons on 31.10.2019 as per the directions of this Court in Criminal Petition No.6751 of 2019, however, no steps are taken to arrest the

accused as alleged by the petitioner. He further submits that respondent No.4 neither tried to apprehend the petitioner or his family members nor threatened them to settle the matter with respondent No.5.

4. In view of the aforesaid submissions, no further orders are required to be passed in the matter.

5. Accordingly, recording the submission of the learned Assistant Government Pleader for Home, the writ petition is closed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition stand closed.
