HON'BLE SRI JUSTI CE M.SATYANARAYANA MURTHY CRI MI NAL PETI TI ON No.6 9 5 1 OF 2 0 1 8 ORDER:

This petition is filed to quash the order, dated 23.04.2018, directing the petitioner to appear before this court in DVC No.204 of 2015 on the file of the Court of IV Metropolitan Magistrate (M.V.Act) at Hyderabad on every date of adjournment.

2.

Petitioner earlier filed Crl.P.No.6145 of 2016 questioning the proceedings in DVC No.204 of 2015 pending on the file of IV Metropolitan Magistrate, Erramanzil, Hyderabad.

While disposing of the petition filed by this petitioner, this court directed this petitioner to appear before the trial court on all dates of hearing and also represent the other petitioners. Since a direction was issued by this court in a criminal petition, the court insisted the petitioner to appear before the court representing the other respondents in the DVC. 3.

In "Giduthuri Kesari Kumar and Ors. v. State of Telangana and Ors.1", this court held that the proceedings in DVC are quasi civil in nature and the court cannot insist appearance of the parties before the court except the presence of the petitioners are required for adjudication of the dispute. Therefore, in view of the guidelines prescribed by this court in Gidu t h u r i Kesar i Ku m ar 's case (supra), the court is bound to 1 2015 (2) ALD (Crl.) 470 (AP)

follow the directions and hence, the court is directed to follow the directions issued by this court.

4.

Accordingly, the Criminal petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. __________________________________ JUSTI CE M.SATYANARAYANA MURTHY Ju ly 5 , 2 0 1 8 LMV
