THE HON'BLE SRI JUSTICE S. RAVI KUMAR C.M.A.No.158 of 2009 JUDGMENT:

When this matter came up on 21.04.2016, at request of advocate for appellant, the matter was adjourned to 03.06.2016 and on that day, at request of advocate for appellant, the matter was again adjourned to 10.06.2016. On 10.06.2016, advocate for respondent requested for adjournment for two weeks. When the matter again came up on 15.07.2016, at request, matter was again adjourned to 02.08.2016. When the matter was again listed on 02.08.2016, as there was no representation for both sides, the matter was directed to be listed today under the caption "For Dismissal". Today when the matter is taken up, listed under the caption "For Dismissal", neither the advocate for appellant appeared nor any representation is made on his behalf.

2. Therefore, the appeal is dismissed for non-prosecution. Miscellaneous petitions, if any, pending in this appeal shall stand dismissed.
