HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.25440 OF 2019 ORDER:
This Writ Petition is filed to declare the action of the respondent Nos.3 and 4 by calling the petitioner to the police station and detaining the petitioner without any case being registered, as being illegal and arbitrary.
Heard the learned Counsel for the petitioner and learned Government Pleader for Home.
Learned Government Pleader for Home on written instructions dated 19.11.2019 whereby the Writ Petition averments are denied, would submit that a complaint was made by one P. Venugopal to the Superintendent of Police, Nagarkurnool on 04.11.2019, which was forwarded to the 4th respondent herein through proper channel on 11.11.2019 for enquiry. Upon the receipt of the said complaint, the 4th respondent informed the petitioner to come to the police station for enquiry. After preliminary enquiry, basing on the complaint of the said P. Venugopal, a case was registered in Crime No.108 of 2019 under Sections 447, 427, 506 read with 34 IPC of Kollapur Police Station on 15.11.2019 and the petitioner herein is arrayed as accused No.2 therein. Learned Assistant Government Pleader on the basis of the written instructions further submits that except doing
investigation in the above case, the respondent police never interfered with the civil disputes at any point of time. Further, it is submitted by the learned Assistant Government Pleader for Home that calling of the petitioner before registering the case, was to enquire into the matter, and thereafter in connection with the investigation into the case, registered against the petitioner. The other averments in the Writ Petition are denied by the official respondents. A copy of the written instructions, along with the copy of the complaint, and FIR registered against the petitioner are placed on record before this Court.
Recording the above submission of the learned Assistant Government Pleader and inasmuch as the crime is registered against the petitioner and is being investigated into by the concerned authorities, no further orders need be passed in this matter.
Accordingly, the writ petition is closed. No orders as to costs.
The miscellaneous petitions pending, if any, shall also stand dismissed.
