O R D E R

(Per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed assailing the e-auction sale notice dated 07.04.2017 issued by Union Bank of India proposing to put the secured assets to auction sale on 16.05.2017. By order dated 11.05.2017, this Court permitted the auction to go on and directed the bank not to finalise the same for a period of eight weeks.

It is now admitted by Sri Rajesh Babu, learned counsel representing Sri N.Venkata Krishna, learned counsel for the petitioner, that the auction sale held on 16.05.2017 failed for want of bidders.

That being so, as the challenge to the auction sale notice dated 07.04.2017 is rendered purely academic, this Court does not propose to adjudicate this writ petition on merits.

The writ petition is accordingly dismissed leaving it open to the petitioner to avail appropriate remedies in accordance with law before appropriate forum as and when a fresh cause of action arises. All issues are left open. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
