HIGH COURT FOR THE STATE OF TELANGANA HYDERABAD MAIN CASE No.:Crl.P.No.9136 of 2023 PROCEEDING SHEET 15.02.2024 Dr.GRR, J I.A. No.2 of 2023 ` This petition is filed by the petitioners-Accused Nos.1 and 2 to relax the conditions imposed by this court vide order dated 27.09.2023 in Crl.P. No.9136 of 2023.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

The learned counsel for the petitioners submitted that the petitioners were granted regular bail in Crime No.249 of 2023 on the file of CCS, DD, Hyderabad, registered for the offences under Sections 406, 420 and 120(B) of IPC and Section 3 & 5 of the Telangana Protection of Depositors of Financial Establishment Act, 1999 vide order dated 27.09.2023 in Crl.P. No.9136 of 2023.

While granting bail, this Court imposed condition that the petitioners should appear before the concerned Station House Officer at 10.00 AM on every Monday and Wednesday till the investigation is completed. The petitioners were appearing regularly since then, twice a week as directed by this Court. The petitioners were permanent residents of Tadikalapudi, Eluru District and they were running an educational institution and the presence of the petitioners was necessary as the X Class examinations were to be held

Crl.P. No.9136 of 2023 in the next month and the petitioners were not in a position to stay at Hyderabad and prayed to relax the said condition. Learned Additional Public Prosecutor submitted that the petitioners were appearing regularly as directed by this Court and had not violated the said condition.

Considering the submissions of both the learned counsel and as the investigation is yet to be completed and charge sheet is not filed even after grant of bail since 27.09.2023, it is considered fit to relax the above condition. Accordingly, the application is allowed and the condition No.(ii) in the operative portion of the order dated 27.09.2023 in Crl.P. No.9136 of 2023 i.e. "The petitioners/Accused Nos.1 and 2 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for a period of investigation, for the purpose of investigation and thereafter, as and when required", is hereby relaxed.
