THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 10122 of 2013 ORDER:

In this Writ Petition, petitioner challenges the inaction of respondent Nos.2 to 5 in taking action against the sixth respondent for causing nuisance to the local residents and neighbours by making illegal construction of religious institution in the name of "God's Grace Ministries Church". Learned Assistant Government Pleader for Home has produced before this Court the written instructions issued by the Sub-Inspector of Police, Malkajgiri Police Station, Rachakonda Commissionerate, and submitted that one M. Vijay Kumari lodged a complaint against the sixth respondent and the same was registered as Crime No.203 of 2013 for the offences punishable under Sections 448, 504 and 506 IPC read with Section 34 IPC and after completion of investigation, necessary charge sheet was filed before the learned X Metropolitan Magistrate, Malkajgiri, and same was numbered as C.C.No.347 of 2013.

In the light of the above, it is evident that the grievance of the petitioner stands redressed.

Accordingly, this Writ Petition is closed.

CKR, J W.P.No.10122 of 2013 One aspect of the matter is that running of any religious institution without there being any permission is in violation of the provisions of the Greater Hyderabad Municipal Corporation Act, 1955. In view of the same, the third respondent - Deputy Commissioner, Greater Hyderabad Municipal Corporation, Malkajgiri, Hyderabad, is directed to consider the said aspect and take necessary action by instructing the authorities concerned strictly so as to ensure that the provisions of the said Act are implemented. It is needless to mention that before passing final orders, the third respondent shall follow the procedure prescribed in law. This exercise shall be completed within a period of eight

(8) weeks from the date of receipt of a copy of this order. Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
