ORDER
This writ petition is filed seeking the following relief: "...to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the proceedings in Rc.No.2/2007, dated .07.2007 of the 3rd respondent as illegal, arbitrary, unjustified, unsustainable, contrary to the notification and violative of Articles 14 and 16 of the Constitution of India, and set aside the same and consequently direct the respondents 1 to 3 to appoint the petitioner as Anganwadi Worker of Kathrivanipeta Village, Jalumuru Mandal, Srikakulam District, basing on the past experience and pass such other order or orders as are deemed fit and proper in the circumstances of the case."
Learned counsel appearing for the petitioner contends that at the time of submitting the application for the post of Anganwadi Worker, the 4th respondent was working as a Ward Member and that without tendering resignation, the 4th respondent ought not to have applied for the said post. Learned Government Pleader for Women and Child Welfare appearing for respondents 1 to 3 produced before this Court the written instructions, wherein it is stated that the 4th respondent has resigned as Ward Member and thereafter, she applied for the post of Anganwadi Worker.
Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that
the 4th respondent was appointed as Anganwadi Worker after tendering her resignation for the post of Ward Member. There are no merits in the writ petition and the same is liable to be dismissed.
Accordingly, the Writ Petition is dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed.
