HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY Civil Revision Petition No.1243 of 2015 ORDER:

This petition under Article 227 of the Constitution of India is filed challenging the order, dated 19.1.2015 in I.A. No.187 of 2011 in O.S.No.6 of 2009 passed by the VI Additional District Judge (FTC) Narsapur, declining to club the suits O.S. No.5 of 2009, O.S. No.6 of 2009 and O.S. No.7 of 2009 with one another and try together on the ground that the parties to the suits are different and the documents sued upon in all the three suits are different.

The present revision is filed though on various grounds, during hearing, Sri Dasari S.V.V.S.V.Prasad, learned counsel for the petitioner, requested this Court to direct the trial Court to decide the suits simultaneously without clubbing with one another. 3.

Sri Polisetty Radhakrishna, learned counsel for the respondent No.1, informed that due to expiry of stay initially granted, the trial has already been commenced, however, did not object for simultaneous trial of the suits. 4.

Therefore, in view of request made by the counsel for the petitioner and unopposed by the respondent No.1, I deem it appropriate to direct the VI Additional District Judge (FTC) Narsapur, to decide the suits O.S. No.5 of 2009, O.S. No.6 of 2009 and O.S. No.7 of 2009 pending on its file simultaneously (without clubbing with one another) as expeditiously as possible preferably within six months from the date of receipt of a copy of the order.

With the above direction, the Civil Revision Petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions, if any, pending in this case, shall stand closed.
