HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22319 OF 2018 O R D E R :

This writ petition is filed challenging the action on the part of the 3rd respondent in attempting to deprive the petitioners of their right to livelihood by removing the pan shop in the premises Number 9-1-45/1 & 2, admeasuring 50 sq.yards, situated adjacent to HP Petrol Bunk, Langer House, Hyderabad.

Heard learned counsel for the petitioners.

Learned Assistant Government Pleader for Home produced written instructions stating that in order to avoid traffic congestion and free flow of vehicles, the Traffic Police have made a special drive on 27.06.2018 and the encroachers have been booked under Section 402 of GHMC Act; that since the petitioners have also encroached the road, they were also booked under the said section and imposed a fine of Rs.3,000/-.

Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed of. However this order will not preclude the petitioners from availing alternate remedy as may be available to them under law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
