There is no representation on behalf of the learned counsel for the petitioner.

It appears from the proceeding sheet that on 10-06-2011, in view of the statement made by the learned standing counsel for Railways that the contract in question was already awarded in favour of the 3rd respondent and the execution of the contract was completed, this court is of the view that since the contract was already awarded, no relief as prayed for can be granted. In the counter affidavit of the 2nd respondent, it was categorically stated that the contract was given to the 3rd respondent vide letter of acceptance dated 13-02-2009 and thereafter, the 3rd respondent commenced the work and also furnished the performance guarantee on 02-03-2009.

In view of the above, this Court is of the opinion that nothing survives in the writ petition to adjudicate further and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. ___________________ C. PRAVEEN KUMAR, J Date: 22-09-2015 Ksn
