Heard Sri Vinod Kumar Tadakamalla, learned counsel for the petitioners, Sri S.Ramachandra Rao, learned Senior Counsel, appearing for 3rd respondent.

Sri Deepak Misra, learned counsel, appearing for respondent Nos.1 and 2 states that he has given up vakalat. 3.
Nobody else has filed appearance for respondent Nos.1 and 2. Therefore, the matter is heard and is being decided. 4.
This Revision Petition is filed challenging the Order dt.16-12-2009 in I.A.No.1040 of 2009 in O.S.No.33 of 2003 of the III Additional District Judge, Tirupati.

Petitioners herein filed I.A.No.1040 of 2009 in O.S.No.33 of 2003 under Order 1 Rule 10 (2) CPC to implead themselves as parties in the said suit. The said application was opposed by respondent Nos.1 and 2.

By order dt.16-12-2009, the said application was dismissed. 7.
Challenging the same, this Revision Petition is filed by the petitioners.

Learned counsel for 3rd respondent states that he has no objection if the Revision Petition is allowed. 9.
Since the respondent Nos.1 and 2 have not engaged any counsel to contest the Revision Petition, it is presumed that they
have also no objection to the Revision being allowed. 10.
Accordingly the Civil Revision Petition is allowed and the order dt.16-12-2009 in I.A.No.1040 of 2009 in O.S.No.33 of 2003 of the III Additional District Judge, Tirupati is set aside and the said I.A. is allowed. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
