This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.2 and 7 seeking bail in connection with F.I.R.No.74 of 2022 dated 22.02.2022 on the file of Khaghaznagar-(T) Police Station, Kumuram Bheem Asifabad District registered for the offences punishable under Sections 306, 342, 324, 323, 290 read with 34 of Indian Penal Code (for short 'IPC'). 2.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record. 3.
The case was registered on 22.02.2022 that the deceased had not returned to their house. The said complaint was filed by the father.
Thereafter, investigation was taken by the police. During the course of investigation, it was found that accused No.1 had created fake account and started chatting with the
deceased, since the deceased had earlier chatted with the girlfriend of accused No.1 on social media (Instagram). Accused No.1 and his friends called the deceased to Khammam where he was manhandled by a group including these petitioners.
Thereafter, the boy committed suicide.

However, keeping in view that the petitioners are students and aged around 24 years and since there are no specific allegations which are leveled against these petitioners except the confession of accused No.1, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-
1) The petitioners/Accused Nos.2 and 7 are directed to surrender before the Station House Officer, Khaghaznagar-(T) Police Station, Kumuram Bheem Asifabad District on 29.09.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.2 and 7 on bail, on their executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only)
with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioners/Accused Nos.2 and 7 shall appear before the concerned police on every Monday for a period of four weeks and thereafter, as and when required for the purpose of investigation.
3) The petitioners/Accused Nos.2 and 7 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
