Modiam Ravi v. The State Of Andhra Pradesh

2017-06-23S.V.Bhatt2 pages

HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.9481 of 2017 ORDER:

The petitioners challenge Notice dated 18.01.2017 issued in Form VIII under Rule 19(1) of Rules read with Section 5(3) of the A.P. Rights in Land and Pattadar Passbooks Act, 1971, as illegal, without jurisdiction and unconstitutional.

2. On 23.03.2017, this court has granted stay of operation of the notice dated 18.01.2017. The writ petition has been listed under the caption for 'extension of interim order'. Learned Assistant Government Pleader places on record the written instructions dated 23.03.2017 and contends that 4th respondent, after expiry of 15 days from the publication of public notice, claims to have caused enquiry and the applications of respondents 5 and 6 were rejected. The notice impugned in the writ petition was issued on the applications filed by respondents 5 and 6. Since 4th respondent has rejected the very applications, challenge to notice dated 18.01.2017 is not pressed.

3. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
