HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.381 of 2013 ORDER:

This petition is filed to withdraw O.P.No.676 of 2013 from the file of Family Court, Ranga Reddy, and transfer the same to Senior Civil Judge, Addanki, Prakasam District.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 03.03.2012 and she joined respondent for leading marital life and after some time respondent and his parents started harassing petitioner for additional dowry and as she was unable to bear the harassment she left the marital house and went to her parents house at Gopalapuram. She stated that she filed M.C.No.13 of 2013 and D.V.C.No.13 of 2013 and they are pending at Additional Judicial Magistrate of First Class, Addanki and suppressing these facts, respondent herein filed O.P.No.676 of 2013 before Family Court, Ranga Reddy, with false allegations. She stated that she is now staying at her parents house and the distance between her place of residence and Hyderabad is about 600 kms. and as she is living on the mercy of her parents, it is difficult for her to undertake journey for such a long distance by meeting necessary expenditure. For these reasons, she prayed for transfer of O.P.No.676 of 2013 from Family Court, Ranga Reddy, to Senior Civil Judge,

Addanki.

This Court permitted petitioner to take personal notice to respondent and in compliance of the same, advocate for petitioner filed memo stating that notice sent to respondent was served on respondent as per the track report of the Postal Department and filed the copy of track report along with memo. As seen from the track report, registered notice that sent on 16.07.2016 was delivered on the addressee on 22.07.2016.

In spite of that, respondent neither appeared in person nor through any advocate.

5. Considering the reasons stated in the affidavit filed in support of petition and also considering the convenience of wife, O.P.No.676 of 2013 is withdrawn from Family Court, Ranga Redy, and transferred to Senior Civil Judge, Addanki, Prakasam District, for disposal in accordance with law.

6. Accordingly, transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand closed.
