THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15911 of 2015 ORDER:

Heard the party-in-person, who filed this Writ Petition seeking a writ of mandamus challenging the action of the first respondent in not conducting the M.Theology second semester examination in April 2015 to the petitioner. The grievance, as I understood from the oral submissions made by the petitioner, is that he pursued the Bachelor of Divinity course in the second respondent College, and at the time of admission, the second respondent College had taken the original certificates from the petitioner. After completion of the Bachelor of Divinity course, the petitioner joined the sixth respondent institution at Chennai, Tamil Nadu, where he produced the transfer certificate given by the second respondent. But, the same was rejected on the ground that it is a fake certificate.

When the petitioner is seeking return of the original certificates from the second respondent, the second respondent is refusing. In the circumstances, the petitioner filed the present Writ Petition. The above grievance appears to be the sum and substance of the case of the petitioner, even though he included several reliefs in the Writ Petition. In the circumstances, this Writ Petition is dismissed as not maintainable in view of the reliefs sought, but giving liberty to the petitioner to pursue his remedies for taking back of original certificates from the second respondent. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
