HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17442 of 2008 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Land Acquisition.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the proceedings in Rc.No.B/322/2008, dated 24.04.2008 issued under Section 4 (1) of the Land Acquisition Act and also the consequential declaration issued under Section 6 (1) of the Land Acquisition Act, published in News Paper on 11.07.2008 by respondent Nos.2 and 3, are illegal, arbitrary and violative of principles of natural justice; and consequently to set-aside the said proceedings.

At the time when the matter is taken up for hearing, it has been brought to the notice of the Court that after conducting an enquiry, Award No.5 of 2011 came to be passed on 04.03.2011. As per the award, an amount of Rs.37,61,907/- was deposited before the Principal Senior Civil Judge, Guntur, on 28.05.2011 vide Cheque No.326005 dated 27.05.2011.

In view of the above, this Court is of the opinion that nothing survives for adjudication in the writ petition and accordingly, the writ petition is closed. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
