THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.10932 OF 2015 O R D E R :
This writ petition is filed for a Writ of Mandamus declaring the action of the respondent No.2 in not substituting the name of the petitioner as a owner of house bearing No.3-2-97, Ambedkar Street, Gambhiraopet Village and Mandal, Karimnagar District in the place of her mother Buchhavva, as illegal and arbitrary and for a consequential direction to the 2nd respondent to consider the representation of the petitioner dated 22.01.2015. The case of the petitioner is that her father purchased the land admeasuring 197 sq.yards situated at Ambedkarnagar, Gambhiraopet, Karimnagar District and constructed a house bearing No.3-2-97. After the death of her father, the petitioner's mother became the absolute owner and house was mutated in her name.
While so, the petitioner's mother out of love and affection gifted the said house to the petitioner through a gift and settlement deed dated 16.12.2014. Thereafter, the petitioner made a representation dated 22.01.2015 to the 2nd respondent requesting him to initiate action for substituting her name in place of her mother as the owner of the said house. But no orders are passed on the same so far. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioner. Sri P.Raghavender Reddy, learned Standing counsel for 2nd respondent submits that the representation made by the petitioner is pending and the same would be considered by the competent authority. Since the representation made by the petitioner is pending before the 2nd respondent, the 2nd respondent is directed to consider the same and pass appropriate orders in accordance with law and thereafter take action accordingly.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
