2017-02-07S.V.Bhatt2 pages

HON'BLE SRI JUSTICE S.V.BHATT W.P. No.33173 OF 2012 ORDER:

The petitioner complains against inaction of respondents in assigning door number to the shed constructed by petitioner in Survey No.30 of Malkapur Gram Panchayat, Karimnagar Mandal, Karimnagar District as illegal and arbitrary. I have perused the material available on record and I am of the view that since the stand taken in the counter affidavit is prima facie not tenable, the writ petition can be disposed of by this Order: The petitioner is given liberty to submit application for allotment/ assignment of door number as is warranted in the circumstances of the case by enclosing a copy of this order to respondent No.2 within six weeks from today.

The 2nd respondent is directed to examine the request in right perspective, take decision and communicate the same to the petitioner. If the petitioner is finally aggrieved by the decision, it is needless to observe that the petitioner can work out remedies in accordance with law.

The writ petition is disposed of accordingly. No order as to costs.

Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT,J Date:07.02.2017 Stp
