The case of the petitioner is that he is a resident of Vadderapalem of Santhanuthalapadu Village & Mandal, Prakasam District and eking out his livelihood by doing mason work in and around the village. The 4th respondent has a liquor shop bearing No.47 near main road and when he want to shift the shop to the residential locality, the petitioner along with the residents of Vadderapalem raised objection and submitted a representation dated 22.05.2017 to the District Collector, Prakasam District and the same was forwarded to the 2nd respondent. But no action has been taken till date. Petitioner apprehends that the respondents would allow the 4th respondent to establish the shop in residential locality against the rules. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Prohibition and Excise. Since it is stated that the petitioner has already submitted representation to the District Collector and the District Collector has already forwarded the said representation to the concerned authorities, it is for the concerned authorities to take the same into account while granting permission to the 4th respondent for shifting the shop.
In view of the same, the 2nd respondent is directed to consider the objections raised by the petitioner, before granting any license or shifting permission to the 4th respondent. Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
