HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37696 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the respondents to furnish the particulars of Amjad Khan, S/o late Mohd. Osman Khan, relating to date of his leaving India.

Heard and perused the material available on record. 3.

It is stated in the affidavit that one Mohd. Amjad Khan, filed two criminal complaints against the petitioner for the offence under Section 138 of the Negotiable Instruments Act and he gave GPA to his wife to represent his cases on the ground that he left for Dubai. The exact date of his leaving India is not known to the petitioner to make out defence whether he was available as on the date of filing of the complaint or execution of GPA in the name of his wife. In that regard, the petitioner made a representation to the 2nd respondent on 14.9.2016 to furnish the particulars of Amjad Khan about his leaving India. But the 2nd respondent has not furnished any such particulars as sought by the petitioner. 4.

If it is the grievance of the petitioner that she made a representation to the 2nd respondent and no reply was received from the 2nd respondent, she is at liberty to invoke the provisions of Right to Information Act and seek information from the 2nd respondent.

With the above observation, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
