HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.205 of 2016 ORDER:

This petition is filed to withdraw O.P.55 of 2016 from the file of Judge, Family Court, City Civil Court, Hyderabad and transfer the same to Senior Civil Judge, Mancherial, Adilabad District.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 13.11.2010 at Royal Gardens, CCC Naspur, Mancherial as per Hindu traditions and caste customs. She stated that respondent started harassing her and finally necked out her from house on 08.03.2015 and having no other alternative, she went to her parents house at Mancherial and now she is staying there on the mercy of her parents. She has stated that she has no independent source of income. It is stated that respondent intentionally filed O.P.No.55 of 2016 before the Family Court, Hyderabad and she has no male assistance to escort her from Mancherial to Hyderabad to defend the proceedings before the Family Court, Hyderabad. She further stated that she has no means to meet the travel expenses from Mancherial to Hyderabad to contest O.P.

This Court permitted the petitioner to take out personal notice to respondent through registered post with acknowledgment and incompliance of the same, notice was sent to respondent through registered post. Advocate for petitioner filed memo stating that as per the track report of the postal department, notice sent to respondent was served on 16.04.2016. Respondent in spite of

service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioner. Perused the affidavit filed in support of the petition.

5. Considering the reasons stated in the affidavit filed in support of the petition and also considering the convenience of the wife, O.P.No.55 of 2016 is withdrawn from the file of Judge, Family Cour t, Hyderabad and transferred to Senior Civil Judge, Mancherial, Adilabad District for disposal in accordance with law.
