THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.7944 of 2017 ORDER:
At the relevant point of time, petitioner was working as Deputy Tahasildar. After consideration of his entitlement, he was included in the panel for Promotion as Tahasildar for the panel year 2006-2007. However, on the ground that disciplinary proceedings were pending against him, he was not promoted. He was later included in the panel for promotion for the panel year 2012-2013 and was granted promotion.
Learned counsel for the petitioner contends that the disciplinary proceedings, which were the cause for not granting promotion in the panel year 2006-2007, were subsequently dropped, but, his promotion was not reviewed. Ventilating his grievance, petitioner submitted a representation on 13.02.2017. Contending that no orders are passed on the said representation, this Writ Petition is filed.
Learned counsel further contends that petitioner is due for retirement on attaining the age of superannuation on 31.07.2017 and if his claim is not considered and promotion is not granted as per his entitlement before his retirement, grave prejudice will be caused to him.
Having regard to the fact that the petitioner has already ventilated his grievance in the representation dated 13.02.2017, this Court is not inclined to keep the writ petition pending. Therefore, the Writ Petition is disposed of directing the Principal Secretary for the State of Telangana (3rd respondent) for considering the claim of the petitioner ventilated in his representation dated 13.02.2017 and pass appropriate orders as
warranted by law assigning reasons in support of the decision and communicate the decision to the petitioner within a period of six weeks from the date of receipt of a copy of this order. Miscellaneous Petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. _____________________ P.NAVEEN RAO, J 24th March, 2017.
