THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.17830 OF 2016 ORDER: {Per the Hon'ble Sri Justice Ramesh Ranganathan} Heard Sri A.V.Krishna Koundinya, learned Senior Counsel appearing on behalf of the petitioner and Sri S.Suri Babu, learned Special Standing Counsel for Commercial Taxes and, with their consent, the Writ Petition is disposed of at the stage of admission. The relief sought for in this Writ Petition is to declare the inaction of the first respondent, in disposing of the petitioner's application under Rule 60 of the Andhra Pradesh Value Added Tax Rules dated 02.05.2016, as being arbitrary and illegal; and for a consequential direction to the first respondent to immediately pass order, in accordance with law, on the petitioner's application dated 02.05.2016.

As the petitioner's request is only to consider the rectification application, and as the said application is pending before the first respondent from 02.05.2016 onwards, we consider it appropriate to direct the first respondent to dispose of the rectification application at the earliest, and in any event within one

(1) week from the date of receipt of a copy of this order. The Writ Petition is, accordingly, allowed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
