THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.9065 of 2014 ORDER:

In this petition filed under Section 482 Cr.P.C, the petitioner/A.3 seeks quashment of the proceedings in C.C.No.1898 of 2013 on the file of XI Metropolitan Magistratecum-Special Mobile Court, Ranga Reddy District at L.B.Nagar. 2 ) The complainant lodged a private complaint with the allegation that A.2 is the wife of A.1 and A.3 is the brother of A.2 and the complainant has got acquaintance with them since last four years and all the accused conducted chit business in different groups with the public and complainant was one of the subscribers and he subscribed the chit of Rs.2,00,000/- for 40 months and he regularly paid chit amount with the fond hope that he would get the dividend which would help him to educate his children and in that process the complainant paid Rs.1,30,000/- and later accused Nos.1 and 2 absconded since April, 2010 and A.3 who was found recently in his house at Saroornagar replied in an abusive language and thus all the accused have cheated the public including complainant.

Learned Magistrate took cognizance of the matter.

4) Denying the allegations, learned counsel for petitioner/A.3 would submit that the petitioner is a Software Engineer and he has nothing to do with the chit business allegedly conducted by

A.1 and A.2 and there is no record to show that A.3 conducted chit business along with A.1 and A.2 and that the complainant subscribed amounts. He thus prayed to quash the proceedings.

5) On a careful scrutiny of the complaint allegations, I find no merits in this petition in view of the strong prima facie case revealed against petitioner/ A.3 and other two accused. Hence, it is not a fit case to quash the proceedings.

6 ) In the result, this Criminal Petition i s accordingly dismissed.

As a sequel, Miscellaneous Petitions pending, if any, shall stand closed.
