THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23940 OF 2016 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the 4th respondent in changing the entries in the revenue records with regard to the land to an extent of Ac.4.01 guntas in Survey Nos.937/E, 939/AA & 960/AA, situated in Podagal Village, Jadcherla Mandal, Mahaboobnagar District, at the instance of the respondents 5 and 6, without waiting till the outcome of the suit in OS.No.46 of 2016 filed for declaration, as illegal and arbitrary and for a consequential direction to the 4th respondent not to alter the existing entries pending disposal of the suit. Learned counsel for the petitioners submits that they have filed suit in OS.No.46 of 2016 for declaration of title along with IA.No.179/2016 for injunction and that pending the suit the respondent authorities cannot change the entries in respect of the land to an extent of Ac.4.01 guntas in Survey Nos.937/E, 939/AA & 960/AA, situated in Podagal Village, Jadcherla Mandal, Mahaboobnagar District.

Learned Assistant Government Pleader for Revenue submits that mere pendency of the suit does not bar the authorities, unless there is any injunction granted by the Court. In view of the above facts and circumstances, since petitioners are claiming that their names are existing in revenue records, the respondent authorities shall issue notice to the petitioners and other affected parties, if any, before effecting any change in the revenue records.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
