THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.896 OF 2014 ORDER:

This Criminal Petition under Section 482 of Cr.P.C. is filed by the accused 1 to 5 seeking to quash the order of III Additional Sessions Judge, Tirupati, Chittoor District dated 18.12.2013 in dismissing Crl.M.P.No.240 of 2013 in S.C.No.21 of 2012 filed by the petitioners under Section 311 Cr.P.C. to recall P.Ws.3,4 and 7 for further cross-examination.

This petition is pending from 2014. No interim stay has been granted by this Court. Learned counsel for the petitioners is not in a position to inform this Court whether the S.C. is still pending.

Considering the facts and circumstances of the case, this Court is of the view that nothing survives for adjudication in this petition and accordingly, the Criminal Petition is dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
