Heard both sides.
Learned counsel for petitioner submits that the bail conditions may be relaxed and surety amount may be reduced from Rs.20,000/ - to Rs.5,000/ - as imposed by the XI Additional Chief Metropolitan Magistrate, Secunderabad in its order dated 12.01.2017.
It is seen that similar application was moved by the petitioner before the Court of Special Judge for trial of offences under SCs. And STs. (POA) Act-cum-VI Additional Metropolitan Sessions Judge, Secunderabad in Crl.M.P.No.714 of 2017 which was dismissed by the said Court on 06.03.2017 observing that the petitioner belong to Hooghli District of West Bengal State and if the surety amount is reduced, there was every possibility of the petitioner jumping bail.
Learned Additional Public Prosecutor while opposing the petition would submit that the petitioner is a habitual offender, in as much as, he was involved in similar type of offences. He pointed out that in Crime No.209 of 2011 of Phydhoni Police Station, Mumbai City, the petitioner along with other accused committed the offences under Section 395 IPC and Section 25(1)(A) of Arms Act and also in Crime No.60 of 2011 of Police Station, Rajahmundry I Town, A.P. State, he along with other
accused committed the offence under Section 395 IPC and those cases are pending.
In the light of the above submissions of the Addl. P.P. to the effect that the petitioner is a habitual offender and cases are pending against him and also in view of the fact that his earlier application was dismissed by the learned Special Judge for trial of offences under SCs. And STs. (POA) Act-cum-VI Additional Metropolitan Sessions Judge, Secunderabad, there are no merits in this petition.
