JUSTI CE J.UMA DEVI WRI T PETI TI ON NO.19926 of 2016 ORDER: (per SK,J) Sri Raghavan K.Thallapaka, learned counsel for the petitioner, would fairly concede that this writ petition as instituted may not survive in as much as the auction purchaser has not even been made a party. He would further seek leave to withdraw the writ petition reserving liberty to the petitioner to file a proper writ petition assailing the e-auction-cum-sale held by the respondent bank.

The writ petition is accordingly dismissed as withdrawn with the liberty aforestated.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
