THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NOS. 7313 & 7314 OF 2022 COMMON ORDER:

Both these Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in Crl.P.7313/2022 and to petitioners/A2 & A3 in Crl.P.No.7314/2022 in Crime No.166 of 2022 on the file of Yellareddypet Police Station, Rajanna Sircilla District, registered for the offences punishable under Section 304-B of Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioner/A1 in Crl.P.7313 of 2022 is the husband of the deceased and the petitioners/A2 & A3 are the parents of the Accused No.1.

The case of the prosecution is that the wife of Accused No.1 committed suicide by hanging herself in the house of A1. The allegation is that the marriage of the deceased with A1 was performed on 06.01.2021 and blessed with a baby girl who is now aged 7 months. After the birth of the said child the petitioners

started harassing the deceased mentally and physically by demanding an amount of Rs.5 lakhs towards dowry. Due to the constant harassment, it is alleged that the deceased vexed with such harassment committed suicide.

According to the Remand Report six witnesses are examined apart from the scene of offence and inquest panchas. 6.

In the said circumstances, when the police had examined the relevant witnesses, these petitioners can be granted the relief of bail subject to the following conditions:

i) The petitioners/A1 to A3 shall execute personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of Judicial Magistrate of First Class at Sircilla, Rajanna Sircilla District.

ii) After release, the petitioner/A1 in Crl.P.7313/2022 shall appear before the concerned Station House Officer, on every Monday between 10.30 A.M. to 1.30 P.M. for a period of eight weeks, for the purpose of investigation. The petitioners/A2 & A3 in Crl.P.No.7314/2022 shall appear before the concerned Station House Officer as and when directed.

iii) The petitioners/A1 to A3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 6.

Accordingly, both the Criminal Petitions are allowed. Miscellaneous applications, pending if any, shall stand closed.
