This writ petition is filed to declare the action of the respondent No.4 in accepting the application form of the respondent No.6 and issuance Form A-4 licence in his favour vide proceedings in L.No.CT/159/2017-19, dated 02-07-2017 for the A-4 shop notified against Serial No.CT/159 Gangavaram Mandal, Chittoor District even though he failed to pay application fee, which is mandatory requirement for participation in the tender process as illegal and arbitrary.

Admittedly, the petitioner has remedy by way of appeal under Section 63 of A.P.Excise Act (for short "the Act") in respect of his grievance in the writ petition. The same is not disputed by learned counsel for the petitioner.

In view of the same, I do not see any reason to interfere with the impugned proceedings and as such, the writ petition is liable to be dismissed.

Accordingly, the writ petition is dismissed granting liberty to the petitioner to avail alternative remedy available under Section 63 of the Act.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
